A habitual drunken driver agreed Thursday to a plea bargain, resulting in a 40-year sentence for causing the death of an off-duty jailer in 2010.

Kellie Lewis pleaded guilty to murder, days before the case was scheduled to go to trial in the 140th District Court.

Lewis had a blood alcohol concentration of more than three times the legal threshold to drive in Texas when she swerved across an interstate median and slammed into 36-year-old Tommy Lamkin’s vehicle in October  2010.

Under Texas law, a person who kills someone while committing a felony can be charged with felony murder.
