Ybarra guilty of intoxication manslaughter

Ron Maloney | Seguin Gazette SAN ANTONIO - A Bexar County jury that heard two weeks of testimony deliberated less than four hours Monday evening and found a Seguin woman guilty of intoxication manslaughter.
Today, the jury of 10 women and two men will begin the punishment phase of the trial of Jenny Ann Ybarra, 32, of Seguin, who faces a punishment range from two to 20 years in state prison. Ybarra could also get probation.
Ybarra has been on trial in 437th Judicial District Court in connection with the high-speed, head-on collision in which Wilson County resident Erica Nicole Smith, 23, suffered life-ending head injuries just before 4 a.m. on Dec. 16, 2007.
The accident received widespread news coverage because San Antonio paramedics who believed Smith dead at the scene as a result of a massive brain injury draped her in a tarp without checking her vital signs. Two hours later, she was discovered to be alive and was taken to Brooke Army Medical Center, where she died 39 hours later.
Smith's family has filed a $10 million wrongful death suit against the city of San Antonio.
