GENERAL DESCRIPTION
Performs highly advanced managerial/technical activities directing and guiding the Insurance Fraud Unit. Responsible for enforcing Insurance Code provisions and other laws related to fraudulent insurance acts. Serves as the chief investigator in charge of fraud and suspected fraudulent activity in the state. Directs, plans, and coordinates the work of a 40-person section involved with complex fraud investigations, insurance regulatory functions, and complex administrative functions. Manages attorneys and investigators assigned to the Dallas County District Attorney’s Office and the Harris County District Attorney’s Office. Works under minimal direction of the Compliance Division Deputy Commissioner with extensive latitude for the use of initiative and independent judgment.
Duties include:
- providing reports and information to agency management regarding legislative and insurance issues;
- representing the agency at legislative sessions, meetings, hearings, conferences, and seminars or on boards, panels, task forces, or committees;
- testifying at hearings and legislative meetings;
- working with executive staff to accomplish agency goals consistent with agency strategic plan;
- planning, assigning, and supervising the work of attorneys, investigators (including commissioned peace officers), and administrative staff;
- developing and implementing techniques for evaluating activities of the Insurance Fraud Unit;
- reviewing and approving insurance fraud referral cases to state and federal prosecution agencies;
- producing a statutorily required annual report regarding the number of cases completed and recommendations for regulatory and statutory responses to the types of fraudulent activities the Insurance Fraud Unit encounters;
- identifying needed areas of change and making recommendations to improve operations;
- implementing a robust training curriculum to maintain an effective investigative unit in tune with current and evolving fraudulent techniques and activities;
- ensuring that all peace officers commissioned by the Insurance Fraud Unit meet existing peace officer standards as defined in the Texas Occupations Code Section 1701;
- designing a safety program to keep staff mindful and engaged about safety concerns in securing information during insurance fraud investigations;
- engaging in strategic workforce planning to recruit, hire, and retain a diverse staff and to support succession planning;
- presenting information about new investigative techniques, fraud scams, and changes in laws to insurance company investigators and local, state, and federal law enforcement;
- overseeing the preparation of management and productivity reports and studies;
- preparing and evaluating program budget requests;
- developing guidelines, procedures, policies, rules, and regulations for effective insurance fraud referrals to law enforcement authorities;
- working with insurance antifraud committees, law enforcement agencies, and insurance fraud associations to increase public and insurance industry awareness of insurance fraud activities, such as the National Association of Insurance Commissioners, the National Insurance Crime Bureau, etc.;
- may commission peace officers to act as insurance fraud investigators;
- providing technical guidance to staff; and
- performing other duties as assigned.

QUALIFICATIONS
Education/Experience:
Graduation from an accredited four-year college or university with a major in business, law enforcement, public administration, or in a field relevant to assignment. PLUS: Five years of experience as a senior executive in the administration of business or government or law with two of those years in work experience related to the position to be held. PREFER: Management expertise; experience as a prosecuting attorney, fraud investigator, or law enforcement administration. Master of Business Administration, Master of Criminal Justice, Master of Public Administration, or Juris Doctorate. Executive experience is defined as experience in a supervisory or management capacity. Experience may be substituted for the educational requirement on a year-for-year basis. Education may not substitute for the experience requirement.
The Texas Department of Insurance will conduct a criminal background check on all final candidates for this position. An applicant who has been convicted of a criminal offense relevant to the position may be disqualified from employment.
This position requires travel in order to carry out the essential functions of the job. The Texas Department of Insurance will check driving records on final candidate(s) for this position to ensure candidate(s) meet(s) the fully qualified driving status as defined by the agency.

- extensive knowledge of local, state, and federal laws and regulations relevant to the position;
- knowledge of principles and practices of public administration and management;
- knowledge of the legislative process and how it affects agency operations;
- skill in presenting complex data, policies, analyses and recommendations to agency staff, the general public, industry advisory committees, law enforcement agencies, insurance fraud associations, and the legislature in a clear and concise manner;
- skill in current fraud detection methods, technologies, and antifraud strategies;
- skill in analyzing information, identifying problems, evaluating alternatives, and implementing effective solutions;
- ability to interpret complex civil and criminal statues and rules;
- ability to communicate and work effectively with all levels of employees and the general public;
- ability to direct the development of policies and procedures; and
- ability to prepare succinct reports.
