Milner v. State - 1st COA

The prosecution of the defendant for attempting to murder his mother-in-law was not barred by double jeopardy because the judge admitted evidence of the attempted murder in his previous trial for the murder of his wife. The evidence of the attempted murder was admissible in the murder trial as same transaction contextual evidence. Because the defendant was not prosecuted for the attempted murder in his murder trial and the trials were for different victims, double jeopardy does not bar the defendant's prosecution. Milner v.
