Killer denied appeal by Supreme Court

Texas death row inmate Ramiro Rubi Ibarra, convicted of strangling and sexually assaulting a teenage girl in Waco in 1987, lost an appeal Monday before the U.S. Supreme Court.
The high court decision makes the 53-year-old Mexican citizen eligible for 54th State District Judge Matt Johnson to set an execution date.
The justices refused to review Ibarra’s claims that he was mentally retarded and ineligible for capital punishment under Supreme Court guidelines. Ibarra also had claimed he was denied legal assistance from the Mexican consulate following his arrest, an alleged violation of Geneva Convention protections.
