Death row inmate convicted of Humble murder to receive new punishment trial

Convicted killer Brian Edward Davis, sentenced to Texas death row for the August 1991 murder of Humble resident Michael Alan Foster, was awarded a new punishment hearing by the Texas Court of Criminal Appeals November 18.
According to court records, the decision was based on the TCCA’s finding that jurors in the original trial received inadequate options in their decision-making for or against the death penalty to give appropriate consideration to mitigating circumstances presented in the case, namely “severe learning disabilities, functional illiteracy, childhood head injuries, deficits in social functioning, drug and alcohol ‘dependency’ by age fifteen, and a physically violent and emotionally traumatic upbringing.”
