Former BMA director on trial in water theft case

HONDO — A La Coste man being tried here on a charge of stealing water to irrigate his farm was selectively prosecuted by the Bexar-Medina-Atascosa Counties Water Control and Improvement District No. 1, his lawyer asserted in court Wednesday.

Attorney Robert Wilson said defendant Ted Kohlleppel, a former board member of the Natalia-based district, was singled out for enforcement because he'd publicly challenged district bills claiming that he owed $16,416 for water delivered between 2006 and 2008.

District Attorney Dan Kindred had a different view of the case against Kohlleppel, who was indicted in October on a charge of theft between $1,500 and $20,000 for allegedly taking more than 7.1 million gallons of water from the district's canal system without paying.
