A Smith County jury sentenced a 61-year-old Arkansas man, convicted of one count of indecency with a child on Wednesday, to a five-year probated prison sentence on Thursday.

Dennis Walker McCandless kissed and inappropriately touched a now13-year-old girl on the mouth in 2005 when she was 8 years old after he picked her up out of her bed and placed her in his bed.

McCandless faced a range of punishment from probation to 20 years in prison.

As a condition of his probation, Judge Jack Skeen Jr. of the 241st Smith County District Court, sentenced McCandless to serve 180 days in the Smith County Jail, day for day, and will have to register as a sex offender for life, said Smith County Assistant District Attorney Jason Parrish. Parrish assisted Smith County Assistant District Attorney Joe Murphy in the prosecution against McCandless, who waived his right to an appeal.
