Menefee v. State
During the defendant's open plea to possession of cocaine with intent
to deliver, his sworn response of "guilty" was not sufficient to satisfy CCP art. 1.15. When the defendant answered the trial court's question, "As to that
charge in the indictment as we've just covered, how do you plead,
guilty or not guilty?" by responding "Guilty, Your Honor," he was only
entering his plea, not confessing the truth or correctness of the
indictment.
