Suspect's actions during police questioning detailed in punishment phase of trial

FORT WORTH — While being questioned by a female sex crime detective, the suspect in the burglary-assault of a 77-year-old woman appeared to perform a sex act on himself, the detective testified Tuesday.
"I was physically shaken," Detective Felicia Cleveland said in the punishment phase of the trial of Mitchel Wayne Stewart, 39.
He had been charged with burglary with intent to commit sex assault, injury to the elderly, assault and theft in the Oct. 26, 2009 home invasion of a Meadowbrook woman.
The day before his trial was to begin in Criminal District Court No. 3, Stewart pleaded guilty to burglary of a habitation and theft.
Despite the plea, prosecutors are presenting most of their case to jurors who will decide Stewart's punishment and whether he used his hands as deadly weapons when he choked the woman.
