Marlin Democrat
Jesse Lee Whigham, 20, of Rosebud pled guilty to the murder of Cap Jake Sudduth Wednesday in District Court proceedings in Marlin. He was sentenced to 40 years confinement in the Texas Department of Criminal Justice.
Whigham will not be eligible for parole until the year 2029.
Sudduth, who was 19 at the time of his death, was found on the side of CR 314 just outside of Rosebud by a passerby around 8:30 a.m. on July 26, 2009.
It was later determined through the use of cell phone records and witness information that the murder occurred around 7 a.m. that morning.
"This offense is what is coined a ā3gā offense because a deadly weapon was involved, which means Whigham will be required to serve at least one half of the sentence before he can be considered for parole," stated District Attorney Jody Gilliam. "It is doubtful that he would be granted parole at that time and will likely serve a longer time in prison."
The case was set for trial on Sept. 13. The trial had previously been set for Aug. 3, but was re-scheduled due to the recovery of evidence.
