Trial set in case of dogs that killed child

History will be made in Young County next week.

When a trial convenes Monday at the Young County Courthouse, a new Texas law will be put into use when District Attorney Stephen Bristow tries a Breckenridge couple on a charge of attack by a dog resulting in death.

The trial will be the first time the charge of attack by dog has been used since it became law in September 2007.

Bristow explained that the law came about after a woman near Georgetown was attacked and killed by a pack of pit bulls in 2005. Because there was no law specifically regarding dog attacks, the owners of the animals were charged with negligent homicide. When the district attorney was unable to prove the owners were negligent because their dogs had never been a threat in the past, the owners were acquitted.
