Midland County District Attorney is currently seeking applicants for two Assistant District Attorney positions in our Misdemeanor Division.
Salary: The base salary is $92,085.63

Summary
Under general direction from the Midland District Attorney, this position represents the State in primarily misdemeanor and justice of the peace cases. Misdemeanor prosecutors also represent the State in seeking Protective Orders for Victims of Family Violence and may appear in juvenile proceedings. While the attorney is assigned to the misdemeanor trial team, the prosecutor will be frequently asked to sit second chair or assigned felony cases on an individual basis. This position requires an enthusiastic, energetic person that wants to work in a busy, well respected office; a great, family-oriented community, and to go to trial regularly in a professional manner.
Essential Duties and Responsibilities
Tasks
Screens, files and prosecutes misdemeanor crimes from intake through trial with the opportunity to assist felony prosecutors in trial; Evaluates cases for filing by reviewing police incident and investigative reports, examining physical evidence and crime scenes, interviewing witnesses, assessing criminal histories, directing additional investigation when necessary, and drafting charging instruments; Counsels and discusses cases with probation officers, law enforcement officials, victims and witnesses; Handles all necessary pre-trial matters including plea-bargain/sentencing negotiations and evidentiary/suppression hearings; Prepares cases for trial by issuing subpoenas, preparing witnesses, manufacturing trial exhibits, filing all necessary motions and notices, and generating trial strategies; Tries both jury and non-jury cases by selecting jury panels, presenting evidence, cross-examining opposing witnesses and making legal arguments; May handle appeals by reviewing court transcripts, assessing all relevant legal issues, conducting legal research, preparing briefs and presenting oral arguments to the Court of Appeals if necessary; May need to respond to citizen inquiries regarding legal issues and current cases.

Qualifications

Knowledge of the methods, practices and courtroom procedures involved in civil and criminal matters
Knowledge of relevant criminal and civil laws including statutes, rules of evidence, case law and appellate procedures
Knowledge of the general principles of criminal case administration and methods of criminal justice practice
Acquire knowledge of Midland County District Attorney’s office regulations, policies and procedures
Acquire knowledge of the general methodologies and practices employed by Midland County law enforcement agencies
Skill in reviewing and interpreting complex legal issues
Skill in screening and preparing cases for presentation to a grand jury
Skill in prosecuting misdemeanor cases
Skill in preparing and presenting cases for appellate review
Skill in managing a mixed criminal and caseload
Skill in establishing and maintaining effective working relationships with supervisors, co-workers, other law enforcement agencies and the public
Attends and participates in law enforcement TLETS training and annual continuing legal education as required by the State of Texas at office expense
Education and Experience
Juris Doctorate from an accredited law school. Preferably, experience in prosecution, although it is not necessary.
Other Qualifications, Certificates, Licenses and Registrations
Must be licensed to practice law in the State of Texas and in good standing with the State Bar of Texas. For individuals awaiting bar results, please refrain submitting a resume until you have received your results. The applicant must be comfortable with technology.

Salary
Beginning salary is $92,085.63. The salary may be increased depending upon experience. Health insurance for the employee is provided at this time by the county. Midland County District Attorney’s office is a member of TDCRS retirement system. Midland County District Attorney’s office will pay the selected candidate’s bar dues, dues for approved associations and approved continuing legal education.
