Appellate Division Prosecutor – Ellis County & District Attorney’s Office
The Ellis County & District Attorney, Lindy Beaty, is accepting applications for an experienced appellate prosecutor. The position will officially open October 1. Our appellate division prosecutors provide professionalism and guidance in all aspects of prosecution, working closely with all divisions .
Position and Salary
Salary range between $146,000 to $171,000.00 dependent upon experience and qualifications
Primary Responsibility of the Appellate Division:
- Seek justice on behalf of the Citizens of Ellis County.
- Provide legal updates to the district attorney and her assistants on current legal and appellate matters.
- Work as a team player in a collaborative environment
- Represents the State in post-conviction appellate matters, including direct appeals and post-conviction writs
- Prepare mandamus actions, notices of appeal, State’s briefs, petitions for discretionary review, post-conviction writ answers, and other responses, motions, and filings to resolve post-conviction matters.
- Represents the State at writ hearings and oral arguments in the 10th Court of Appeals and at the Court of Criminal Appeals.
- Provides legal research and legal advice to trial attorneys as needed.
- Provides training regarding legal areas, as requested.
- Handles motions for expunction and nondisclosure of records.
- Performs advanced legal work. Conducts investigations to determine best court or non-court action. Performs complex legal research.
- Creates documents including answers, motions, orders, plea documents, writs and other related documents, keeping our office up to date on legal formalities.
- Conducts training, mentoring, and educational presentations regarding legal and community justice issues of concern to prosecutors and staff, as well as other government employees, law enforcement officers and civic organizations.
- Confers with top management in matters concerning policies and procedures of our office.
- Assist in preparing cases for trial. Provide guidance and expertise to trial attorneys on legal issues and trial strategies.
- Performs other job-related duties as assigned.
Must have a JD from an accredited law school; be licensed to practice law in the State of Texas and in good standing with the State Bar of Texas; be proficient in civil law, government law, employment law and construction law; have strong leadership skills; be detailed oriented; and pass a background check.
Preferred Qualifications:
- 5 years of experience working in appellate law.
- Board certified in Texas criminal appellate law.
