POSITION CLASSIFICATION DESCRIPTION
Serves as Assistant District Attorney for 51st and 119th District Attorneys. Under direction of 51st and 119th District Attorneys, manages and prosecutes caseload of felony criminal cases in district court and performs related legal functions.
The annual salary is 69,158.74.
Essential Duties and Responsibilities:
As part of intake process, reviews and analyzes felony cases referred by law enforcement agencies; prepares proposed indictments, gathers evidence, confers with witnesses, visits crime scenes, prepares subpoenas and search warrants, confers with law enforcement officials, and assists in presentation of cases to grand jury;
Manages and prosecutes all aspects of felony criminal caseload from intake through appeal, including indicted cases, motions to revoke probation, and assigned civil asset forfeiture cases, in district court;
Prepares for and participates in pretrial hearings, jury selection, trial, suppression hearings, bond reduction hearings, probation revocation hearings, and other contested proceedings in district court, as directed;
May manage, or assist in management of, juvenile caseload including case evaluation with the juvenile probation department, drafting of petitions, and participation in detention hearings, adjudication hearings, and trials as directed;
Conducts plea negotiations with defense counsel;
Conducts legal research using a variety of references and resources;
Drafts appellate briefs and may argue appeals;
Responds to inquiries from law enforcement officers regarding criminal law and criminal procedure;
Responds to inquiries from the public regarding legal matters;
Files for protective orders, as needed;
May assist with grant preparation and reporting;
Attends and conducts meetings and training sessions; performs other duties, as assigned.
Knowledge, Abilities, and Skills:
Knowledge of federal and state laws, regulations, and precedents; knowledge of legal procedures and the methods and practices of pleading cases;
Ability to understand and interpret statutes, constitutional provisions, and administrative regulations; ability to effectively prepare and litigate cases in court; ability to work effectively with members of the legal profession, law enforcement personnel, co-workers, county department representatives, and the public.
Skill in oral and written communication.
Physical Requirements and Work Setting:
Works in a well-lighted, air-conditioned environment; prolonged periods of sitting and periodic walking, standing, bending, and reaching; occasional lifting up to 15 lbs; visual acuity, hearing ability, and manual dexterity required.
Education and/or Experience Required:
Juris Doctor Degree from an accredited school of law and at least one year of experience as an attorney, preferably practicing in the area of criminal law.
Certificates and Licenses:
License to practice law in the State of Texas.
